right now in this investigation. we have learned a short time ago that the suspect, dzhokhar tsarnaev, now will not face criminal charges until tomorrow. even though massachusetts doesn't have the death penalty, he should face the death penalty under federal law. >> this is just kind of case that it should be applied to. in fact, the only other time it has been used since '94 is on timothy mcbay. given the facts i have seen, it would be appropriate to use the death penalty in this case and i would hope they would apply it in federal court. >> reporter: there is growing evidence today that his brother, tamerlan tsarnaev had become incredibly radical. this video of a radical jihadist was posted and then removed from his personal youtube channel. he created it in august shortly after an extended visit to russia. there are increasing questions about how the fbi handled its investigation of tamerlan tsarnaev. they did not follow up after that trip to russia last year. the very latest on the investigation from our crime and justice correspondent, mr. joe johns. joe joins us from washington.
the road where the two boston marathon suspects, tamerlan and dzhokhar tsarnaev were engaging in this gunfight with police. we'll scroll through a couple of these pictures. keep your eyes here on the screen. the photos here show the brothers huddling behind a stolen suv at times as we reported through the hours last week, shooting at police, before this older brother tamerlan charges, runs towards these officers here, then he's seen lying in the street. the suv driven by his younger brother who we know is in fair condition at this hour at a hospital here in boston, he's in the car, accelerates toward his older brother, on the ground. >> what is the context for that? do they believe he was trying to escape, do they believe he was trying to maybe separate his brother from the officers or is there anything on this? >> i think his brother was on the ground, his brother was enga engaging, strapped with explosives and the younger brother from everything i've gleaned wants to get out of there. >> maybe because of the explosives. what does he wind up doing? >> ultimately gets out of t
to is they are taking the claims that dzhokhar tsarnaev has made and taking a look at whether the two brothers may have learned their expertise online. one of the things they are looking at is an online publication called inspire. this is a publication essentially, online site, sponsored by al qaeda in the arabian peninsula essentially al qaeda in yemen. amongst the extremist jihady move. well known, in existence for many years. they published some time back a recipe for making a pressure cooker bomb in an article that they basically entitled "how to make a bomb in your mother's kitchen" the belief is there may be similarities between this online recipe and what was used in boston. investigators are looking at this very closely. chris? >> barbara, thank you very much. another piece in the puzzle. as people understand this information, and you hear it, it's important to tell everybody it's not about building this up or dramatizing, it's about understanding exactly how this could have happened and why. barbara, thank you very much. we'll be back to you. >>> not far from here in the boston suburb of massa
